Irizarry 3D Prints
1. Acceptance of Terms
By placing an order with Irizarry 3D Prints (“the Company”), the client (“the Client”) expressly accepts these Terms and Conditions of Sale in full, without reservation.
The Client explicitly waives the application of its own standard terms and conditions, even if issued after these Terms. Any deviation from these Terms must be expressly agreed to in writing and in advance by Irizarry 3D Prints.
2. Scope of Services
Irizarry 3D Prints provides 3D printing services and finished 3D printed products based on designs that are either:
- Licensed from third-party creators, or
- Provided by the Client where applicable.
Irizarry 3D Prints does not sell or transfer design ownership unless explicitly stated in writing.
3. Licensing & Intellectual Property
All intellectual property rights related to 3D models, designs, and files remain the exclusive property of their respective creators or rights holders.
Irizarry 3D Prints is authorized only to manufacture and sell physical prints under applicable licenses.
The Client acquires no rights to reproduce, distribute, resell, reverse-engineer, or modify any design files.
Any misuse of licensed designs by the Client is the sole responsibility of the Client. Irizarry 3D Prints shall not be held liable for any licensing violations committed by the Client or third parties.
4. Orders & Production Variations
Due to the nature of additive manufacturing:
- Minor variations in color, texture, layer lines, surface finish, strength, or dimensions may occur.
- Such variations are normal and acceptable and do not constitute defects.
Dimensions are subject to industry-standard tolerances. Exact cosmetic perfection is not guaranteed unless explicitly agreed upon in writing.
5. Pricing & Payment Terms
All orders require payment before fulfillment.
- Custom or made-to-order items require a non-refundable deposit of fifty percent (50%) of the total order value before production begins.
- The remaining balance, including shipping, taxes, and any additional charges, must be paid in full prior to shipment or pickup.
- In-stock items must be paid in full at checkout.
- Irizarry 3D Prints does not offer invoicing, credit, or “pay later” options under any circumstances unless expressly agreed to in writing.
Failure to complete payment may result in order cancellation, production suspension, or forfeiture of any deposit paid.
6. Taxes & Withholding
All prices listed by Irizarry 3D Prints are exclusive of applicable sales tax and shipping fees unless otherwise stated.
- Connecticut sales tax will be applied where required by law.
- Shipping costs, if applicable, are calculated at checkout or agreed upon before fulfillment.
- Any additional taxes, duties, or government-imposed fees required by the delivery destination are the responsibility of the Client.
Irizarry 3D Prints does not control tax rates or shipping carrier fees and cannot be held responsible for changes imposed by state authorities or carriers.
7. Delivery & Timelines
Irizarry 3D Prints will make reasonable efforts to meet stated production and delivery timeframes.
However, all timelines are estimates only and not guarantees.
Delays caused by material shortages, machine maintenance, shipping carriers, force majeure events, or circumstances beyond reasonable control shall not constitute breach of contract.
8. Inspection, Claims & Returns
The Client is responsible for inspecting all products promptly upon delivery or pickup.
- For residential deliveries, products must be inspected within twenty-four (24) hours of confirmed delivery.
- For deliveries made to a facility, carrier location, or pickup point, the Client must inspect the product immediately at the time of pickup. By removing the product from the facility or pickup location, the Client confirms acceptance of the product in its condition at pickup.
Any issues, defects, or concerns must be reported to Irizarry 3D Prints within twenty-four (24) hours of delivery or pickup so we may assist appropriately. Claims reported after this timeframe may not be accepted.
If damage occurs during shipping, such damage is the responsibility of the shipping carrier. The Client must file any shipping damage claims directly with the carrier under the carrier’s insurance and claims process. Irizarry 3D Prints may provide reasonable documentation upon request but cannot submit claims on the Client’s behalf.
9. Limitation of Liability
Irizarry 3D Prints’ liability is strictly limited to the amount paid for the product or service in question.
Under no circumstances shall Irizarry 3D Prints be liable for:
- Indirect or consequential damages
- Loss of profit, revenue, or business
- Third-party claims
- Improper use, modification, or resale of products
Irizarry 3D Prints shall not be required to participate as a third party in any claim brought against the Client by an end consumer.
10. Product Use & Safety
Irizarry 3D Prints’ liability is strictly limited to the amount paid by the Client for the specific product or service giving rise to the claim.
Products are manufactured using a variety of 3D printing materials, each with distinct characteristics and limitations. The Client acknowledges that certain materials may be sensitive to factors such as heat, moisture, ultraviolet exposure, or mechanical stress. Where provided, product descriptions, care instructions, and recommended use guidelines must be followed. Exposure to conditions outside the intended or recommended use—including, but not limited to, high-temperature environments such as dishwashers, enclosed vehicles in extreme heat, or industrial settings—may result in deformation, warping, or damage and does not constitute a manufacturing defect.
Products are intended for use as described in their individual product listings. Some items may be suitable for play or display, while others are intended solely for decorative or non-interactive use. Unless explicitly stated otherwise in the product description, items are not intended for use by small children and should be kept out of reach of infants and toddlers. The Client is responsible for supervising children and ensuring that products are not placed in the mouth or used in a manner inconsistent with their intended purpose.
To the fullest extent permitted by law, Irizarry 3D Prints shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of use, loss of profit, personal injury, or third-party claims arising from misuse, modification, improper care, lack of supervision, or use of the product contrary to its stated purpose or common safety practices.
11. Force Majeure
Irizarry 3D Prints shall not be held liable for failure or delay in performance resulting from events beyond reasonable control, including but not limited to natural disasters, supply chain disruptions, labor disputes, or governmental actions.
12. Termination
Irizarry 3D Prints reserves the right to refuse or cancel any order at its discretion, including but not limited to suspected fraud, licensing concerns, or abusive behavior.
13. Governing Law & Jurisdiction
All contractual relationships shall be governed exclusively by the laws of the United States.
Any dispute shall fall under the exclusive jurisdiction of the competent courts within the United States.
